Many RLS compliance violations can be avoided by keeping listing information accurate and up to date. Below are the five most common violations, along with simple steps to help you prevent them and quickly resolve them if they occur.
#1 Listing Issues- This notice is to inform agents that their listing has been removed from all RLS data feeds due to their inactive REBNY membership or a change in office affiliation. To resolve this they can log in to www.myREBNY.com or contact the REBNY Membership Department at membership@rebny.com or 212-616-5200 to resolve your membership status as soon as possible.
#2 Missing Listings- Ensure the listing has been successfully submitted to the RLS.
Per UCBA, you are required to enter the exclusive listing to the RLS: a) simultaneously with any public dissemination of such Exclusive Listing; or b) simultaneously with any showing of the Exclusive Listing to any Buyer, whichever is earlier.
#3 Incorrect Status - Ensure that your listings are up to date with the correct status. Any change in status shall be entered into the RLS by the earlier of: 1) simultaneous with any change made over any public website or portal (including, but not limited to, any RBD Member’s website); or 2) within twenty-four (24) hours (not including weekends and postal holidays) after the authorized change is received by the Exclusive Agent.
#4 Expired Listing- Change the status of the listing to Expired when the listing has passed the Expiration Date or update the Expiration Date (if the listing agreement has been renewed).
#5 Incomplete or Incorrect Owner Opt-Out Form- Use the current Owner Opt-Out Form and ensure it is fully completed before submitting it to the RLS within 48 hours of executing the Exclusive Listing Agreement. For detailed requirements and the latest form, see the Owner Opt-Out Form Submission Guide.
