Days on Market Calculation 

Upon submission to the RLS, Exclusive Listings with “Participant Only Network” and “Coming Soon” status shall not accrue “days on market” until such time as the status or permission is changed. 

Calculation of “days on market” shall be reset to zero (0) when the Exclusive Property is i) sold or rented (transaction set to “closed”); ii) in “withdrawn” status for thirty (30) consecutive days; or iii) in “cancelled” status for thirty (30) consecutive days.  The previous threshold was ninety (90) days. (See Article I. Section 11) 

Seller’s Agent’s Duty to Disclose Offers to Seller

Provision added requiring, upon request, RLS Participants to verify transmission of an offer to the seller. This section is also amended to require disclosure in cases where there is only one offer. (See Article II. Section 11) 

“Related Entities” Language Added to Termination of Exclusive Listing Procedures

"Or any such related entity” language is added throughout the section for clarity and consistency. (See Article II. Section 13)

Updated Mode of Submission for RLS Owner Opt-Out Form

The requirement to submit the Owner Opt-Out Form to the RLS by email is removed and replaced by a requirement to submit Owner Opt-Out Form with the Exclusive Listing through the Exclusive Agent’s LMP. (See Exhibit B)   

RUNDBA Revisions to Account for Buyer Broker Representation Agreements

Because the Buyer Broker Representation Agreement provides a definitive timeframe wherein the broker represents the Prospect, the RUNDBA no longer requires that a purchase agreement be signed by the Prospect within 60 days of the registration for the broker to earn a commission. The RUNDBA also now states that commissions are not set by law and are fully negotiable. Other updates to the RUNDBA outline situations where the broker is disqualified from receiving a commission. These include:  

  • the Sponsor's agent receives a letter from the Prospect stating that the Prospect has terminated their buyer broker representation agreement with the Outside Broker,  

  • the Prospect presents a buyer broker representation agreement with a broker other than the Outside Broker, the Sponsor's agent or the Outside Broker's co-broker, or  

  • prior to making an offer or signing a purchase agreement, the Prospect has made repeated visits to the property without the outside broker or any other broker. (See Exhibit D)
